Refund policy
AERIAL™ RETURNS, REFUNDS & WARRANTY POLICY
At Aerial™, we want you to be completely satisfied with your purchase. This Returns, Refunds & Warranty Policy explains when products may be returned, exchanged, repaired or refunded.
This policy applies to purchases made through the Aerial™ online store and is intended to operate in accordance with applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA") and the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), as amended from time to time.
Nothing in this policy limits, excludes or waives any right that you may have under South African law. Where a statutory consumer right applies, that right will prevail over this policy.
1. OUR PRODUCT
Our principal product is the Aerial™ Renew Electric Makeup Brush Cleaner.
Because this is an electrical personal-care device, customers are expected to use the product strictly in accordance with the instructions, safety information and intended purpose supplied with the product.
2. ONLINE COOLING-OFF RIGHT
If you purchase an Aerial™ product through our online store, you may have a statutory right under section 44 of ECTA to cancel the transaction without giving a reason and without penalty within 7 days after receiving the goods, subject to the exclusions contained in ECTA.
Where this statutory cooling-off right applies:
- You do not need to provide a reason for cancelling.
- You may be responsible for the direct cost of returning the product.
- The product must be returned to us.
- Where payment has already been made, the applicable refund will be processed in accordance with ECTA.
- We may require the product to be returned before completing the refund where permitted by law.
ECTA provides that a refund under its cooling-off provision must be made within 30 days of cancellation.
Important
The statutory cooling-off right is separate from your rights relating to defective, unsafe or non-conforming goods under the CPA.
Accordingly, a customer does not lose statutory rights merely because a product has been opened or used where the law otherwise provides a right of return.
3. CHANGE-OF-MIND RETURNS
Where a customer wishes to return a product simply because they have changed their mind, the return will be dealt with according to the applicable statutory rights.
Where no statutory right to a return applies, Aerial™ may, at its discretion, offer a voluntary return or exchange subject to the conditions communicated to the customer at the time of purchase.
For voluntary change-of-mind returns, we may require that:
- the product is unused;
- the product is in substantially the same condition in which it was supplied;
- all accessories, attachments, manuals and components are returned;
- the original packaging is included where reasonably possible; and
- the customer pays the applicable return delivery costs.
These conditions do not restrict any statutory right available to the consumer under South African law.
4. DEFECTIVE, UNSAFE OR FAULTY PRODUCTS
Aerial™ complies with the statutory implied warranty of quality applicable to goods supplied to consumers under section 56 of the CPA.
Generally, goods must be reasonably suitable for their intended purpose, of good quality, in good working order, free of defects, and usable and durable for a reasonable period having regard to the circumstances.
If your Aerial™ product fails to meet the applicable requirements of section 55 of the CPA, you may return the product within 6 months after delivery, subject to the requirements of the CPA.
A valid statutory return for defective or non-conforming goods will be handled without penalty and at the supplier's risk and expense, as required by section 56.
Where section 56 applies, the consumer is entitled to the applicable statutory remedy, which may include:
- repair of the product;
- replacement of the product; or
- a refund of the price paid for the product.
The consumer's statutory rights will determine the applicable remedy. Aerial™ will not use this policy to remove or reduce those rights.
5. WHAT IS NOT GENERALLY CONSIDERED A PRODUCT DEFECT
Subject always to applicable South African law, a product will generally not be regarded as defective merely because damage or failure was caused by circumstances outside the product's intended use.
Examples may include:
- accidental damage;
- misuse or abuse;
- use contrary to the supplied instructions;
- failure to follow safety instructions;
- unauthorised modification or repair;
- use with an incompatible charger, power source or accessory;
- water or liquid entering parts of the device that are not designed to be exposed to liquid;
- dropping, crushing or physically damaging the device;
- use for a purpose for which the product was not designed;
- normal cosmetic wear and tear;
- damage caused after delivery by the customer or another person;
- failure caused by an external electrical surge or other external event; or
- damage caused by negligent handling or storage.
However, these exclusions will not be applied where doing so would unlawfully limit a consumer's statutory rights.
6. REPAIRS
If a product qualifies for a statutory warranty remedy and repair is appropriate, Aerial™ may arrange for the product to be inspected and repaired where permitted by law.
If a product is repaired under the CPA's implied warranty and the same product subsequently fails again within the applicable statutory period, additional statutory remedies may arise.
Aerial™ will comply with the remedies required by applicable law.
7. PRODUCTS DAMAGED AFTER DELIVERY
Customers should inspect their parcel and product as soon as reasonably possible after delivery.
If your product appears to have been damaged during delivery, please contact us as soon as possible and provide:
- your order number;
- photographs of the outer packaging;
- photographs of the product;
- photographs of any visible damage; and
- a description of the issue.
Please retain the original packaging until the matter has been resolved.
Reporting delivery damage promptly helps us investigate the matter with the courier, but failure to report damage immediately does not by itself remove any statutory rights you may have under South African law.
8. INCORRECT, INCOMPLETE OR DIFFERENT PRODUCT RECEIVED
If you receive:
- the wrong product;
- an incorrect quantity;
- a product materially different from the product ordered; or
- a product missing components that were included with your order,
please contact us as soon as reasonably possible.
We will investigate the issue and, where Aerial™ is responsible, provide the appropriate remedy required by applicable law.
Depending on the circumstances, this may include:
- supplying the correct product;
- supplying missing components;
- replacing the affected product; or
- providing a refund.
Where the law requires Aerial™ to bear the return cost, we will do so.
9. CHANGE OF MIND AFTER USING THE PRODUCT
Because the Aerial™ Renew is an electrical personal-care product, we strongly recommend that customers inspect the product before use and follow all instructions carefully.
Where a customer is exercising a statutory cooling-off right, Aerial™ will process the return in accordance with the applicable requirements of ECTA.
Where a customer is requesting a voluntary return outside a statutory right, Aerial™ may impose reasonable conditions concerning the condition of the product, including whether it has been used, damaged, modified or returned without its components.
These voluntary-return conditions do not override statutory consumer rights.
10. RETURNING YOUR PRODUCT

We may request photographs or videos before arranging a return where reasonably necessary to understand the issue.
For defective-product claims, we may require the product to be returned for inspection.
Please do not send a product to an address unless Aerial™ has provided the appropriate return instructions.
11. PRODUCT INSPECTION
Where an inspection is reasonably required, Aerial™ may inspect the returned product to determine:
- whether the product corresponds with the order;
- whether a defect or fault exists;
- whether the reported issue is consistent with the product's intended use;
- whether the product has been modified or repaired without authorisation;
- whether there is evidence of accidental damage or misuse; and
- what remedy is applicable under South African law.
An inspection does not remove or reduce any statutory rights available to the consumer.
12. REFUNDS
Where a refund is legally due, Aerial™ will process the refund in accordance with the applicable law and the circumstances of the return.
Where reasonably possible, refunds will generally be made using the original payment method.
Depending on the payment provider, bank or payment method used, the time for the refunded funds to appear in the customer's account may vary.
Aerial™ is not responsible for delays caused solely by a bank, payment processor or other third-party payment provider after Aerial™ has processed the refund.
13. SHIPPING AND RETURN COSTS
Change-of-mind / statutory online cooling-off return
Where the customer is exercising a statutory ECTA cooling-off right, the customer may be responsible for the direct cost of returning the goods, as permitted by section 44 of ECTA.
Defective or non-conforming product
Where the return is made under an applicable statutory warranty and the law requires the supplier to bear the return cost, Aerial™ will bear the applicable return cost.
Voluntary return
For returns that are not required by law, Aerial™ may require the customer to pay return shipping costs.
14. PRODUCTS PURCHASED ON SALE OR WITH A DISCOUNT
A sale, promotional price, discount or special offer does not remove or reduce a consumer's statutory rights.
A product purchased during a promotion remains subject to applicable consumer protection laws.
Where a product is genuinely defective or otherwise fails to meet the requirements of South African law, the applicable statutory remedies remain available.
15. GIFT PURCHASES
If an item was purchased as a gift, the refund will generally be made to the original purchaser/payment method, subject to applicable law and the payment provider's requirements.
Any statutory rights belonging to the consumer remain unaffected.
